Please note that you are entering into a legally binding agreement. geektrust is a website of Swai Technologies Private Limited, and our mission is to connect developers with opportunities that enable them to be more successful. These terms and conditions govern your use of this website; by using this website, you accept these terms and conditions in full and without reservation. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this website.You agree that by clicking “Register”, “Sign-up”, “Create Account” or something similar to use our services, you are entering into a legally binding agreement. Your agreement will be with Swai Technologies Private Limited.

License to use website

Your account belongs to you. If geektrust provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential. You alone are responsible for your password and user ID security. geektrust may disable your user ID and password at geektrust's sole discretion without notice or explanation.

Unless otherwise stated, geektrust and/or its licensors own the intellectual property rights published on this website and materials used on geektrust. Subject to the license below, all these intellectual property rights are reserved. You may view, download for caching purposes only, and print pages, files or other content from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.

Our Services allow messaging and sharing of information such as your profile details, code evaluation and code you have submitted. Where we have made settings available, we will honour the choices you make about who can see content or information (e.g., sharing your contact details to a company or recruiter only with your explicit consent)

We are not obligated to publish any information or content on our Service and can remove it in our sole discretion, with or without notice. geektrust will evaluate code that you submit in response to a coding challenge. We will put in our best effort but geektrust does not guarantee the accuracy of these evaluations. You agree that under no circumstances will geektrust be liable in any way for any evaluation, including any errors or omissions in any evaluation, or any loss or damage of any kind incurred as a result of your code evaluation. You understand that you must evaluate and bear all risks associated with the submission of code, including any reliance on the evaluation from geektrust. YOU AGREE TO WAIVE, AND HEREBY DO WAIVE, ANY LEGAL OR EQUITABLE RIGHTS OR REMEDIES YOU HAVE OR MAY HAVE AGAINST geektrust WITH RESPECT THERETO. If you do not agree with this, you must not use this website. If you have signed up but would like us to delete your account at any point, mail us at info@geektrust.in and we will do so.

No warranties

This website is provided “as is” without any representations or warranties, express or implied. geektrust makes no representations or warranties in relation to this website or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, geektrust does not warrant that: this website will be constantly available, or available at all; or the information on this website is complete, true, accurate or non-misleading.

Limitations of liability

geektrust will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website: to the extent that the website is provided free-of-charge, for any direct loss; for any indirect, special or consequential loss; or for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data. These limitations of liability apply even if geektrust has been expressly advised of the potential loss.

Exceptions

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit the liability of SWAI Technologies Private Limited in respect of any: death or personal injury caused by the negligence of geektrust or its agents, employees or shareholders/owners; fraud or fraudulent misrepresentation on the part of geektrust; or matter which it would be illegal or unlawful for geektrust to exclude or limit, or to attempt or purport to exclude or limit, its liability.

Reasonableness

By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, you must not use this website.

Other parties

You accept that, as a limited liability entity, geektrust has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against geektrust's officers or employees in respect of any losses you suffer in connection with the website. Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect geektrust's officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as geektrust.

Unenforceable provisions

If any provision of this website disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.

Indemnity

You hereby indemnify geektrust and undertake to keep geektrust indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by geektrust to a third party in settlement of a claim or dispute on the advice of geektrust's legal advisers) incurred or suffered by geektrust arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

Breaches of these terms and conditions

Without prejudice to geektrust's other rights under these terms and conditions, if you breach these terms and conditions in any way, geektrust may take such action as geektrust deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Variation

geektrust may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire agreement

These terms and conditions, together with geektrust's Privacy Policy constitute the entire agreement between you and geektrust in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.

Law and jurisdiction

These terms and conditions will be governed by and construed in accordance with the laws of india, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of india.

Domestic use

geektrust makes no representation that the Website or services are appropriate or available for use in locations outside India. Users who access the Website from outside India do so at their own risk and initiative and must bear all responsibility for compliance with any applicable local laws.

Referral Terms & Conditions

Referring a friend is a great way to tell others about geektrust. With all offers, there are a few rules (or Terms and Conditions, but let’s not get too formal) so everyone plays fair. Here they are…

Referral T&Cs

To participate, only valid geektrust referral email ids will be considered (no mailinator, spambot, fakeinbox, etc.)
The referred candidate must be new (and not a returning or existing) geektrust candidate.
Referral links should only be used for personal and non-commercial purposes, publishing them anywhere is not allowed.
We may terminate your eligibility to earn referral gifts or terminate your account if you open multiple accounts in order to generate additional referral credits.
The incentive for code submissions will only be received when the referred candidate solves a geektrust coding challenge (with build package) on their own (no plagiarism allowed) and submits it on the website.
The incentives apply only on one code submission per referred candidate. Resubmissions or multiple code submissions from the same candidate will not be counted.
Please note that we follow a monthly cycle for all our payouts/incentives. Hence, if you qualify for one or more incentives in a given month, your incentive will be processed within the first 10 days of the next month.
The referral bonus of Rs 25000 will only be provided only once the referee has spent 3 months at the new job.
The referral bonus will be Rs 25,000 or 30% of the finders fee paid by the company to geektrust, whichever is lower.

Eligibility

We may terminate your eligibility to earn referral gifts or terminate your account, or the accounts of geektrust.com members you refer, if you or they take any of the following actions:

Open multiple accounts, including with different e-mail addresses, for the same person in order to generate additional referral credits.
Refer customers using spam, display advertising, sponsored links, unsolicited e-mails, or links on message boards or forums.
Use false names, false emails, impersonate other people, or otherwise provide false or misleading information to us.
Violate these terms or any other terms and conditions on geektrust.in, including but not limited to the referral program terms in any way.

Participation

Participation in the geektrust.com referral program may require you to submit personal information about you and the friends you refer, such as name and email address. You agree to receive communications from us with regard to your participation in the geektrust.com referral program, and to allow us to communicate with your friends about your participation (for example, by disclosing to your friends that an invitation was sent by you unless you have referred a friend anonymously).

Termination and change

We reserve the right in our sole discretion at any time and without prior notice to you to add to, remove or otherwise change these terms, including without limitation: changing the type/amount of the referral gifts, modifying how you may earn and spend referral gifts, modifying the duration and expiration of gifts, required minimum referral criteria for each level, instituting maximum amount of referral gifts that you may earn, and discontinuing the geektrust.com referral program entirely. We will post an updated version of these terms on the geektrust.com website, and you will be deemed to have accepted such changes by continuing to use the geektrust.com website or the referral program after the date such changes are posted.
